The purpose of these Terms and Conditions of Sales is to set out the rights and obligations of both parties, exclusively because of the relationships they initiate on the internet, with respect to any online sales of Products offered on the Site.

Note: The following, together with the documents referred to on it, tells you the terms and conditions on which we supply any of the Goods listed on our website www.wendeeou.com to you. You should read these terms and conditions carefully before ordering any Goods from our site. Please note that by ordering any of our Goods, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference.


 

1. PRODUCT AVAILABILITY AND AUTHENTICITY

All products are subject to availability; and we reserve the right to limit the quantity of products we supply. We also reserve the right to alter any special offers or sale promotion. We will inform you if we are unable to fill your order.

We guarantee the authenticity of all products purchased through www.wendeeou.com. Wendee Ou products are crafted with the highest quality materials, design and workmanship.

The products are for personal use by the user, and not directly intended for the latter's professional use.

 

2. HOW TO PURCHASE

Depending on availability, purchases may be made either directly through www.wendeeou.com or through the assistance of our online personal assistants at sales@wendeeou.com.

After placing an order, you will receive an email from us acknowledging that we have received your order. All orders are subject to acceptance by us and we will confirm acceptance to you by sending you an email that confirms that the Goods have been dispatched (the Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those Goods whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Goods which may have been part of your order until the dispatch of such Goods has been confirmed in a separate Dispatch Confirmation.


 

3. PRICING

Prices displayed on the Wendee Ou website are quoted in GBP including any VAT and applicable taxes. While we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of the merchandise you have ordered, we will give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled.

Please note that the prices indicated are not inclusive of the shipping and delivery charges, which will be added to the total amount due as set out in our Delivery Guide.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

 

4. PAYMENT

Wendee Ou uses SagePay and Paypal as the payment gateways for our online purchases.

For added security, your billing address at www.wendeeou.com must exactly match the address on file at your credit card company or Paypal account. The processing of your order may be delayed if these addresses are different.

The transaction will be charged to your credit card or directly through your bank account via Paypal only after we have verified your card details, received credit authorisation and confirmed stock availability, and that your order is ready to be shipped.

 

5. CHANGES AND CANCELLATIONS

If you wish to cancel or modify your order, please send an email as soon as possible to contact@wendeeou.com.

We will make every effort to accommodate your request. However, please note that orders are processed as quickly as possible and that, once an order has been submitted, we cannot guarantee the purchase can be cancelled or modified. Once you have received your online order, please refer to our return instructions included with your shipment. If you would like to purchase a different product, please visit our website or contact a member of our sales team at contact@wendeeou.com.

 

6. YOUR STATUS

By placing an order through our site, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.

 

7. CONSUMER RIGHTS

If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Goods. In this case, you will receive a full refund of the price paid for the Goods in accordance with our refunds policy.

 

8. OUR LIABILITY

We warrant to you that any Goods purchased from us through our site are of satisfactory quality and reasonably fit for all the purposes for which Goods of the kind are commonly supplied.

Our liability for losses you suffer as a result of us breaking this agreement, including deliberate breaches, is strictly limited to the purchase price of the Goods you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited to: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data.

 

9. IMPORT DUTY

If you order Goods from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable for any breach by you of any such laws.

 

10. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

We reserve the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

 

11. GOVERNING LAW AND JURISDICTION

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. DATA PROTECTION

You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. The personal information concerning users gathered for online sales is necessary for processing orders and delivery, as well as invoicing. Such information is strictly confidential and is not disclosed to third parties except for credit reference or fraud prevention purposes. Any missing information will entail the automatic refusal of the order.

Wendee Ou uses appropriate security measures to protect the information you provide to us. However, while we take reasonable steps to protect this personal information from unauthorised access, you accept that no Internet data transmission can be guaranteed to be secure from access by unintended recipients and will not hold us responsible for any breach of security unless this breach is due to our gross negligence.

 

SHIPPING AND DELIVERIES

We charge a flat shipping fee of £6 to the UK, £15 to all European countries and £25 to the rest of the World. You can expect to receive your items 3-10 working days after purchase.

Unfortunately, at this time, we can only ship to one address per order. If your order contains items that need to be sent to more than one location, you will need to place a separate order for each address.

All goods are insured against theft and accidental damage whilst in transit from our Dispatch centre to their final shipping address. Once an item is delivered and signed for, it is no longer covered by insurance.

If for some reason a box arrives damaged, we recommend you either refuse delivery or make a note when signing that you’re accepting a damaged box.

It is possible to add items to an existing order only if your order has not already been processed and shipped. If you wish to add to an existing order and are unsure whether it has shipped, please emailcontact@wendeeou.com. If your order has shipped, there is no way to add another item. You will need to place a new order with the additional item(s) you desire.

A shipping confirmation will be emailed to you as soon as your purchase has been shipped, which will allow you to track the status of your shipment. In addition, we will email a delivery confirmation once we receive notification that your purchase has been delivered.

Please note that we do not have any control over delays caused by destination customs.

Please note: Due to ongoing restrictions with Russian customs out of our control, we can currently only ship to a business/company address. Please enter a business address at the checkout stage and ensure you follow the tracking progress in case they require any further details during transit.

 

REFUNDS POLICY

We happily accept returned goods – our aim is to make sure every customer is pleased with our products. All returned products must be new and unused, with all tags still attached. We may not be able to accept returned goods if they are not received in that condition. We recommend you return the items in the original packaging to ensure the necessary protection when in transit.

 

To cancel a contract, you must inform us in writing. You must also return the Goods to us immediately (informing us in writing of your intention to return the Goods prior to postage). Failure to inform us in writing of your intention to return the Goods prior to postage may result in a delay in the process.

Full-priced product must be returned/exchanged within 15 days from date of delivery; however, sale product must be returned/exchanged within 10 days of delivery.

When you return Goods to us:

a. because you have cancelled the contract between us, we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, we will refund the price of the Goods in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us

b. for any other reason (for instance, because you do not agree to any changes in these terms and conditions or in any of our policies, or because you claim that the Goods are defective), we will examine the returned Goods and will notify you of your refund via email within a reasonable period of time. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via email that you were entitled to a refund for the defective Goods. Goods returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the reasonable costs incurred by you in returning the item to us (if any and provided that you have returned the item(s) to us by recorded and/or special delivery)

c. Goods that have been personalised will not be refunded or exchanged in any circumstances.

d. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. Where payment has been made by credit or debit card, we will refund the payment to the credit or debit card used to purchase the Goods. If payment was made via Paypal, then the refunded amount will be credited to your Paypal account.

e. You will receive a notification email once your return is processed.

f. All sales tax is refunded for orders sent within the EU. Outside the EU, customs duties and sales taxes are non-refundable. However, you may be able to recover these fees by contacting your local customs office directly.

g. Easy-to-follow instructions for returning/exchanging merchandise are included with each shipment.

h. We reserve the right to refuse return or exchange of any merchandise that does not meet the above requirements.
